PRIVACY POLICY AND COOKIE INFORMATION

 

Privacy Policy defines the principles of processing personal data collected through the website www.graphgroup.pl, hereinafter referred to as "GRAPH GROUP" or the "website". The purpose of the Privacy Policy and the Cookie Information is to define the principles of collecting, processing, and using personal data about Users and their behavior collected by GRAPH GROUP Vitalii Lutskov, headquartered in Warsaw at Al. Sikorskiego 18/28, 02-754, Warsaw, Poland, within the framework of the website www.graphgroup.pl. GRAPH GROUP makes every effort to ensure the protection of privacy for its Users and maintain confidentiality in the personal information provided, including the secure processing of online purchases within the e-store.

1. DEFINITIONS.

 

Whenever in this Privacy Policy the following terms are mentioned:

  • Administrator – this refers to GRAPH GROUP Vitalii Lutskov, headquartered in Warsaw at Al. Sikorskiego 18/28, 02-754, Warsaw, Poland (hereinafter: "Administrator" or "GRAPH GROUP");

  • Personal data – this refers to all information about an identified or identifiable natural person through one or several specific factors defining the physical, physiological, genetic, mental, economic, cultural, or social identity, including device IP, location data, internet identifier, and information collected through cookies and other similar technologies;

  • Policy – this refers to this Privacy Policy;

  • GDPR – this refers to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;

  • Website, e-store – this refers to the website operated by the Administrator at www.graphgroup.pl;

  • User, Customer – this refers to any natural person visiting the e-store or using one or more services or functionalities described in the Policy;

  • Cookies – this refers to data stored on the User's device when the User visits the website; cookies are encrypted, so unauthorized persons do not have access to them; a cookie is a small text file placed on the User's device; cookies help analyze web traffic; cookies allow adjusting the User's operations to their needs, preferences, and dislikes by collecting and remembering information about the User's preferences. Most cookies do not collect personal data identifying the User, instead gathering more general information such as how Users access our sites or the general location of the User. However, certain information stored in cookies, especially when combined with other information, may be treated as personal data. Personal data collected through cookies may only be processed to perform specific functions related to the User's use of the e-store. Such data is encrypted in a way that prevents unauthorized persons from accessing it.

 

2. PERSONAL DATA PROTECTION.

 

Personal data processing is carried out in accordance with the requirements of applicable law, including in particular the provisions of the GDPR. We inform you that we do not intend to transfer your personal data to a third country (by third country, we mean countries outside the EU and EEA).

2.2. Legal basis and purpose of processing the User's data.

 

  • Article 6.1.b GDPR – for taking actions prior to the conclusion of a contract at the request of the data subject or for the performance of a contract to which the data subject is a party, contacting the User, including for purposes related to the provision of services and sale of goods, including generating an order placed through the e-store;

  • Article 6.1.c GDPR – for the purpose of fulfilling a legal obligation imposed on the Administrator, handling complaints, and fulfilling tax and accounting obligations.

  • Article 6.1.f GDPR – legitimate interest of the Administrator – for the purpose of marketing their own products or services, pursuing or securing claims, conducting technical quality analyses of provided services and equipment, and for statistical purposes.

  • Article 6.1.a GDPR – consent of the User – including for the purpose of registering an account in the e-store, sending newsletters.

  • The legal basis for data processing is also:

- Act of 10 May 2018 on the Protection of Personal Data (Journal of Laws 2018, item 1000, as amended);

- Act of 11 March 2004 on the Goods and Services Tax (Journal of Laws 2017, item 1221, as amended);

- Act of 29 September 1994 on Accounting (Journal of Laws 2018, item 395, as amended);

- Act of 29 August 1997, Tax Ordinance, Journal of Laws 2018, item 800, as amended).

 

2.3. Types of personal data processed and methods of data collection by the Administrator.

 

  • The Administrator collects User data in the following ways:

- by the User voluntarily providing data in the registration, contact, or order forms;

- by collecting data through cookies (end devices);

  • The User voluntarily fills out the form with the necessary data to complete the current task (e.g., placing an order), which is collected by the Administrator. The Administrator may automatically record information about the connection parameters (such as the timestamp and IP address).

  • When using the GRAPH GROUP service, the Client may be asked to provide personal data by filling out a form or in another way. Please provide only the data necessary for the operation of the online store. Personal data is provided voluntarily, in connection with the sales contracts, with the understanding that failure to provide the required data during the registration process will prevent the creation of the Client's account, and in the case of placing an order without registration, it will prevent the submission and processing of the Client's order.

  • Personal data is collected in the following cases:

 

  • Account registration on the GRAPH GROUP website

During registration, we ask for the data necessary to create and manage an individual account in the GRAPH GROUP store:

           - first and last name;

           - e-mail address;

           - contact phone number;

           - PWZ number (Professional License Number);;

           - Tax Identification Number (NIP);

           - company name and address.

During the account registration on the GRAPH GROUP website, the Client independently sets a unique password to access their account, which can be changed later by the Client.

 

  • Ordering services and products without registration

Ordering services and products offered on the GRAPH GROUP website without creating an individual account is possible after prior authorization by the GRAPH GROUP administrator.

 

  • Newsletter subscription

Sending commercial information to the Client electronically requires providing the data necessary for sending:

2.4. Recipients of personal data.

 

Odbiorcami danych mogą być pracownicy Administratora, podmioty z nim współpracujące, w szczególności, podmioty obsługujące płatności, dostarczające produkty, podmioty realizujące wysyłki, zapewniające usługi dodatkowe związane z zawartą transakcją, biorące udział w obsłudze reklamacji, banki, dostawcy usług hostingowych, podmioty realizujące usługi w zakresie IT, podmioty świadczące na rzecz Administratora usługi księgowe, doradcze, marketingowe, serwisowe, pocztowe, podmiot utylizujący - tj. podmioty świadczące na rzecz Administratora usługi na podstawie zawartych umów i umów o powierzenie przetwarzania danych osobowych. W szczególnych sytuacjach, w których obowiązujące prawo nakazuje administratorowi udostępnienie zebranych danych, GRAPH GROUP udostępni je uprawnionym organom państwowym.

 

2.5. Okres przechowywania danych osobowych.

 

The recipients of personal data may include the Administrator's employees, entities cooperating with the Administrator, particularly those handling payments, delivering products, carrying out shipments, providing additional services related to the concluded transaction, involved in handling complaints, banks, hosting service providers, entities providing IT services, entities offering accounting, advisory, marketing, postal, and service services to the Administrator, as well as waste disposal entities – that is, entities providing services to the Administrator based on concluded contracts and data processing agreements. In specific situations where applicable law requires the Administrator to disclose collected data, GRAPH GROUP will provide it to authorized state authorities.

2.6. Client's rights.

 

  • The Administrator places great importance on protecting the confidentiality and privacy of the provided information. Providing data by the User of the online store is voluntary but necessary to use the functions of the online store, such as placing and processing an order (concluding a sales contract) and registering an account.

  • At any time, you can withdraw consent to entrust your data to the Administrator by voluntarily discontinuing the use of the aforementioned functionalities of the online store. Personal data left in the online store will not be sold or shared with third parties.

  • The User has the right to file a complaint with the President of the Personal Data Protection Office if they become aware of unlawful data processing by the Administrator.

  • The User has the right to access their data, correct it, delete it, restrict its processing, and transfer the data. In cases where processing is based on the legitimate interests of the Administrator (Article 6.1.f of the GDPR), the User has the right to object to the processing of personal data if there are specific reasons related to their particular situation, or if the data is being processed for direct marketing purposes, in accordance with Article 21 of the GDPR.

2.7. Data security.

 

The Administrator strives to ensure the security of all personal data provided by Users by implementing appropriate technical and organizational measures to guarantee the highest level of security. The Administrator uses the following solutions to ensure:

  • encryption of the connection using an SSL certificate;

  • the ability to continuously ensure the confidentiality, integrity, availability, and resilience of processing systems and services;

  • the ability to quickly restore the availability of personal data and access to it in the event of a physical or technical incident;

  • in addition, the Administrator regularly tests and evaluates the effectiveness of the technical and organizational measures implemented to ensure the security of data processing.

 

2.8. Profiling.

 

On the GRAPH GROUP website, content may be automatically tailored to the needs of Clients through the analysis of their personal preferences, using the personal data they have provided (profiling). If the User does not agree with this practice, they should contact the Administrator at: info@graphgroup.pl. The User always has the right to object to the automatic customization of offers for the Client by the Administrator. The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

 

3. COOKIES.

 

3.1. The entity placing.

 

The entity placing cookies on the User's end device and gaining access to them is the operator of the online store, GRAPH GROUP Vitalii Lutskov.

 

3.2. The purpose of storing and accessing information.

3.4. Changes to the Privacy Policy and Additional Provisions.

 

  • GRAPH GROUP reserves the right to change the Privacy Policy, and will inform Clients electronically via the email address provided during registration. The current Privacy Policy can be found on the website www.graphgroup.pl.

  • The Administrator's online store may contain links to other websites; however, the Administrator is not responsible for the data processing practices on those sites.
